CISS-Cooperazione Internazionale Sud Sud is launching a tender for the development of a justice atlas, roundtables and a training on human rights in the framework of "Enhancing access to justice of vulnerable groups" - NEAR-TS/2022/438-478. This project is co-funded by the European Union and aims to improve the capabilities in the access to justice for vulnerable groups in Moldavia

About the Project:

Art. 1 OBJECT OF THE TENDER:

In the framework of the project, Candidates must provide reliable information regarding experience and capabilities of supporting access to justice for vulnerable groups in the Central Region of Moldova through three different activities described below. The proposed activities must start not before January 2024 and end not later than June 2024.

Description of the activities

Based on the priorities identified by the territorial stakeholders during the project activities, mobile legal clinic services are provided to different types of vulnerable groups in Chișinău Municipality, Rezina, Şoldăneşt. Teleneşti, and Ungheni. The model of intervention proposed is articulated in 4 sub-activities implemented in parallel.

 A.1.2.1 Free legal aid offered to vulnerable groups through visits on the field conducted by three mobile clinics and online sessions: mobile legal clinics composed by 1 lawyer, 1 legal advisor and 2 social workers (selected among professionals such as psychologist, social assistant, educator or cultural mediator) conduct field visits on a weekly basis in different districts targeted by the intervention to provide legal advices to vulnerable individuals selected with the support of the local authorities and CSOs according to a protocol of referral mechanism specifically created by the project which involves also the paralegals. Online sessions through Skype, Viber and Zoom are also provided by the legal clinics at the counselling centres established in Chișinău.

 A.1.2.2 Legal literacy sessions carried out by the mobile clinics in vulnerable communities: on a monthly basis, the mobile teams organize legal literacy sessions targeting local citizens and focus on specific themes where the members of the rural or marginal community (e.g. the Roma communities) need legal alphabetization.

 A.1.2.3 Complementary educational support services offered to vulnerable groups/communities: according to the specific needs of the target groups, additional complementary psychosocial and educational support is provided by the social workers which form part of the mobile team, such as linguistic support, translations, cultural mediation, art-therapy for the victims of violence or crèche activities for the children, peer education sessions for youths in conflict with the law, etc

. A.1.2.4 Follow-up of the legal cases to facilitate access to courts: based on an individual assessment, the teams of the legal clinics cooperate with the lawyers providing free legal assistance guaranteed by the state to ensure the legal representation and the defence of the rights of the vulnerable individual in the competent court (ordinary court or court of appeal) or identifying alternative measures including the submission of the applications to the European Court of Human Rights, when it is appropriate.

Deliverables: Brochures of the project referral mechanism; information flyers on specific legal issues; forms, satisfaction surveys, individual files and appeals to court.

Target Groups: 200 vulnerable persons (at least 60% women) receive individual legal assistance; 1,000 local citizens of vulnerable communities benefiting from legal alphabetization sessions; ca. 1,500 local citizens living in the areas of intervention have access to online resources

Art. 3 - PLACE AND PERIOD:

Art. 5 - Procedures and terms for the presentation of the applications.

The application (Annex I syllabus and Annex II proposed budget) must be presented by the candidates together with a proof of relevant experiences, and CVs of members by hand at the CISS headquarters located in via Marconi 2a, 90141 Palermo, or by e-mail to g.illescas@cissong.org specifying in the subject: "Enhancing Access - Activities proposal " no later than 10/01/25, under penalty of inadmissibility.

Applications will be excluded if:

  • received after the terms indicated in this Notice;
  • they do not meet the admissibility requirements referred to in this Notice;
  • are accompanied by incomplete documentation;
  • are not duly completed, dated and signed.

Article 7 - Treatment of personal data.

The data, elements and any information acquired by participating in this notice will be used by CISS exclusively for the purposes of this procedure, guaranteeing the absolute security and confidentiality also in the data processing with automatic and manual systems. CISS informs interested candidates, pursuant to and for the purposes of art. 13 of the legislative decree n.196/2003 ("Privacy Code") and of the EU Regulation n. 2016/679 ("GDPR 2016/679"), which:

  • the requested data are collected for the purposes inherent to the procedure, governed by the law;
  • the provision of the requested data is mandatory under penalty of exclusion;
  • the data collected may be communicated to employees of the Association responsible for the procedure, or in any case involved in it for reasons of service;
  • the data will be processed using tools, including IT tools, suitable for guaranteeing the data security and confidentiality;
  • the data and documents will be communicated to the bodies of the judicial authority in the context of any proceedings;
  • The rights of the interested parties are those provided for by art. 7 of the legislative decree n. 196/2003;
  • the data controller is CISS / South South International Cooperation;
  • the data processor is the CISS

Article 8 - Possible appeals.

Any appeals can be presented in the first instance to CISS, for an amicable settlement and in case of disagreement to the competent judge.

Article 9 - Final provisions.

The evaluation of the applications received will be delegated to a commission composed of two members, a member of the CISS board of directors and the coordinator of the CISS administrative unit, based on the evaluation of the Training's proposal, trainers' curricula and the correlation between previous experience and the preferential requirements. The commission assigns, for each criterion, a variable score from zero to the maximum score expected and reported in the following table.

The maximum total achievable score is 30 points, as the sum of the scores assigned in each evaluation area. The commission will express its unquestionable judgement based on the requirements and the curricula presented. At the end of its work, the commission will draw up a ranking for the service covered by this public notice. The results of the comparative assessment procedure will be announced by posting on the notice board of the CISS.

The CISS, before signing the contract, may in any case carry out appropriate checks on the truthfulness of the statements made by the candidates and if the need, convenience or the opportunity fails, the CISS may not proceed with the assignment of the service.

The CISS reserves every and unquestionable faculty of discretionary evaluation regarding the qualifications possessed by the candidates.

In the event that CISS receives only one application for this notice, it reserves the right to select the candidate without prejudice to the verification of compliance with the eligibility requirements.

Pursuant to art. 13 of Legislative Decree 196/2003 and subsequent additions / amendments, the personal data provided by the candidate will be collected at the CISS headquarters and processed for the purposes of managing the selection and the established collaboration relationship.

CISS reserves the right to extend, suspend, modify or revoke this notice, for justified reasons and in the public interest, at any time without any claim or right arising from the competitors.
