IOM is dedicated to promoting humane and orderly migration for the benefit of all. It does so by providing services and advice to governments and migrants.
- Nature of the consultancy: Provision of technical legal assistance for the development of Standard Operating Procedures (SOP) on the use of smuggling detection kits , Category B Consultancy.
- Project Context and Scope:
Within the framework of the “Strengthening National Policing Capacity in the Republic of Moldova” project, IOM is supporting the Ministry of Internal Affairs and the General Police Inspectorate (GIP) in ensuring safe and well-monitored border movement and flow of goods, strengthening and enhancing its efforts to prevent and combat cross-border crime, especially illegal transportation of undeclared and prohibited goods.
To support these efforts, IOM donated to the General Police Inspectorate (GIP) a number of smuggling detection kits—equipment used to identify the illegal transportation of undeclared goods. Additionally, training sessions and workshops, were conducted for frontline police officers on topics related to preventing and combating smuggling operations. To further consolidate these activities and introduce an uniformed approach for the use of counter smuggling equipment the GIP representatives requested the development of applicable Standard Operating Procedures (SOPs).
This assistance will be provided considering the needs and requirements of national authorities, through a consultative approach to include the engagement of an expert working group on the SOP development, consisting of representatives of the relevant national authorities, EUBAM and Frontex.

Under the present Terms of Reference, IOM Moldova is seeking an national qualified and experienced expert that will interact and collaborate with the working group on the development of Standard Operating Procedures (SOPs). The expert will offer specialized legal support, assisting in the development of the Standard Operating Procedures (SOP).
Under the overall guidance of the IOM Chief of Mission and Programme Coordinator – Migration Governance, and the direct supervision of Programme Officer/IBG Unit, the incumbent will:
- Provide conceptual, legal, technical and specialized input for the drafting of the SOP on the use of smuggling detection kits - the portable scanners (Viken Detection Nighthawk Scanning Systems) and anti-smuggling inspection kits (CT-40) based on best practices identified in other EU countries;
- Review national legislative framework and perform legal analysis on the particularities, possibilities and limitations in the use of smuggling detection kits;
- Collaborate with other relevant consultants and staff and support the organization and coordination of necessary meetings/interactions with GIP and other relevant stakeholders, including IOM staff and representatives of partner organizations such as EUBAM and FRONTEX;
- Contribute to the drafting of the structure and content of the SOP in collaboration with the other consultants and stakeholders, as well as to any other related necessary notes, analysis, presentations, documentation;
- Support the planning and agenda formulation for the activity of the working group, documentation of activities, report writing;
- Review the final draft in Romanian language, to ensure the legality and accuracy aspect of the text to be shared as final product to the national authority;
- Organize and attend the final presentation workshop for the endorsement of the final draft version of the Standard Operating Procedures;

Payment Modalities
The consultant will deliver his services on-line, or in-person as necessary. IOM will cover interpretation and translation services on the bases of the requirements from the side of the expert and working group, as well as the expenses incurred from the organization of the workshop.
The payment will be done in one instalment, upon submission of the last deliverable (Deliverable 4).
The consultant must adhere to the International Organization for Migration (IOM) Data Protection Principles (IN/138) and maintain confidentiality.
The consultants will be responsible to follow IOM writing guidelines and latest glossaries in all given assignments for accurate translation.

EDUCATION
Master’s degree in law, police studies, border security, customs services, with relevant professional experience of using specialized equipment (including counter smuggling).
EXPERIENCE
- Minimum 5 (five) years of relevant training experience;
- Prior work experience with national authorities and proven experience in supporting national authorities in SOPs elaboration;
- Excellent drafting skills as well as capacity to analyse complex institutional frameworks and make recommendations on this basis;
- Excellent ability to collaborate with national institutions;
- Personal commitment, efficiency, flexibility, drive for results;
- Ability to work effectively and harmoniously with counterparts and colleagues from varied cultures and professional backgrounds;
LANGUAGES
For this position knowledge of English is an asset.
