USAID MISRA is looking for a Local Legal Consultant – Regional Investment Profiles

Work Plan Activity: Task 2.2.2 (FY24WP): Facilitating investment attraction and development of the regional investment profiles
Background
The USAID Moldova Institutional and Structural Reform Activity (MISRA) is a five-year project funded by the United States Agency for International Development (USAID) and implemented by Nathan Associates Inc. MISRA’s objective is to stimulate a sustainable and inclusive recovery from the regional crisis, improve the institutional, business, and trade enabling environment in Moldova by supporting Moldova’s public institutions and the private sector to accelerate the implementation of trade liberalization mechanisms, adopt structural and investment climate reforms, accelerate financial sector reforms, improve economic governance in the public sector, and enhance strategic communications between the private and public actors. MISRA builds on prior and ongoing USAID and US Government activities in the business enabling environment and trade facilitation space to strengthen Moldova’s economic growth and resilience, and by doing so, increase transparency and accountability.
Activity Overview
The Invest Moldova Agency (IMA) stands as the central hub for prospective investors, offering tailored assistance to guide them through investment decision-making and supporting existing investors in expanding their ventures. The agency's overarching objective is to catalyze economic growth by strengthening Moldova's allure for foreign investments, supporting investment initiatives, safeguarding investments, promoting exports, and fortifying economic diplomacy.
The Republic of Moldova faces a significant need for investment in its infrastructure. The absence of adequate infrastructure, encompassing roads, communication networks, logistics, and industrial infrastructure, not only hampers the absorption capacity of foreign investors but also impedes overall economic development. Notably, since July 2022, Moldova has attained EU candidate status, leading to an expedited process of legislative harmonization and providing access to funds for infrastructure modernization and development.
In this context, the Invest Moldova Agency (IMA) will be supported through: 1) the development of at least five regional investment profiles encompassing government-owned assets, such as old factories and plants, investment initiatives by local public authorities, and logistic hubs offered to potential investors through a denationalization process; and 2) a guide for potential investors on participating at denationalization auctions.
The regional investment profiles will be presented to such stakeholders as foreign ministers, development and infrastructure ministers from other countries, international development agencies, and private companies expressing interest in investing in Moldova.
The denationalization auction guide will be utilized by the IMA and the above institutions to share with potential investors. Denationalization serves as a pivotal strategy to attract both foreign and local private investments, fostering increased efficiencies and job creation. To facilitate this, to the guide will provide potential investors with clear insights into the main legal provisions governing participation in denationalization auctions. The conditions, methods, procedures of the denationalization process are outlined in the Law No. 121/2007, on the administration and denationalization of public property. the guide will include timelines, procedures, and requisite documents for potential investors navigating the denationalization auction process.
Responsibilities and Tasks
The Consultant will be responsible for the following:
Task 1. Develop five Regional Investment Profiles;
Task 2. Develop the denationalization auction Guideline;
Deliverables
The Consultant will produce the following deliverables:
- Five Regional Investment Profiles, by May 31, 2024.
- Denationalization Auction Guideline, by May 31, 2024.
- Finalization report summarizing the work completed, findings, and recommendations, using MISRA template, by June 15, 2024.
Skills and Qualifications
- Advanced degree in law with a focus on commercial, investment, or international law.
- Extensive experience in legal practice, particularly in areas related to investment, denationalization, and infrastructure development.
- Demonstrated ability to interact with Moldova’s government authorities and institutions preferred.
- Experience working with USAID and/or other international donors preferred.
- Strong writing and speaking skills in Romanian are required; proficiency in English is preferred.
- Excellent communication and collaboration skills.
- Ability to work independently and as part of a multidisciplinary team.
Supervisory Responsibilities and Reporting
The Consultant will coordinate tasks and deliverables directly with the Component 2 Structural Reform Team Lead and Structural Reform Expert.
