The European Center for Not-for-Profit Law Stichting (ECNL) and the International Center for Not-for-Profit Law (ICNL) are developing the Assessment of the Legal Framework for Philanthropy in Moldova (“Assessment”), which analyzes the current legal framework for individual and corporate philanthropy, including the percentage designation mechanism, under the Moldova: Enhancing Civil Society Financial Sustainability program. The program is supported by the Justice, Rights, and Security – Rapid Response Assistance (JURIS), financed by USAID, and implemented by Democracy International (DI) and a consortium of partners.

Timeline: February 26-June 30, 2024

Scope of Work:

As part of the Assessment, the legal expert on philanthropy will assist the ICNL/ECNL team with the following (non-exhaustive list):

1. Assist with identifying relevant laws and implementing regulations, under guidance by ICNL/ECNL (we will provide a basic list of laws we are aware of, areas for relevant legislation and illustrative titles of acts of potential interest).
2. Identify relevant sections in laws/ regulations for translation.
3. Review laws and analyse specific issues identified by ICNL/ ECNL: limited research on selected topics.
4. Assist with formulating requests for information in compliance with Moldova access to information law requirements.
5. Provide limited input to and review of ICNL/ECNL desktop report to ensure accuracy of Moldovan law references and interpretation.
6. Provide consultations relating to Moldovan legislation with ICNL/ ECNL experts on an as-needed basis.
7. Participate in individual interviews jointly with ICNL/ ECNL expert (up to 15); consultations to ICNL/ ECNL in preparation of the interviews and on processing results.
8. Participate and assist with the facilitation of discussion of one focus group; consultations to ICNL/ ECNL in preparation of agenda for the focus group and on processing results.
9. Follow-up contacts with interview/focus group participants for clarification of issues raised.
10. Review data on results of interviews and consultations.
11. Provide limited input to and review of draft assessment report to ensure accuracy of Moldovan law references and interpretation.
12. Advise on stakeholders for participation in the roundtable presenting the assessment. 
13. Other tasks, relevant to the Assessment.

Qualifications:

• Law degree from an accredited Moldovan school.
• At least five years of professional experience in law and practice.
• Excellent research, analytical, writing, and presentation skills (need to provide a writing sample).
• Fluency in English, both written and oral.
• Professional experience working on tax, philanthropy, finance and banking laws is desired.  
• Demonstrated knowledge of the situation of civil society and philanthropy issues in Moldova is desired.

Eligibility criteria:

This call is open to individuals or organisations, with a preference for candidates based in Moldova. Most work will be carried out remotely, although in-person meetings are possible to the extent feasible. Under this project, there are 20 expert days planned in the time frame of February - June 2024.

Confidential treatment of the deliverables:

The deliverables should not be distributed or shared with third parties, before they are published by ECNL.
