Project discription

Comunitatea Mea (CM) is a 5-year program funded by the United States Agency for International Development (USAID) and administered by IREX. The program’s purpose is to improve the capacity of local public authorities (LPAs), including their ability to work inclusively with citizens and civil society, to increase revenues, improve financial management practices, build stronger checks and balances between the central and local governments, and facilitate public-private partnerships and inter-municipal cooperation.

Position summary

CM seeks a consultant to:

  1. Develop the Information Note (Notă informativă) and the Regulatory Impact Assessment (Analiza impactului de reglementare) to accompany the draft Government decision on the adoption of the Methodology for calculating and setting tariffs for public waste management services in the Republic of Moldova (the Methodology).
  2. Edit the Methodology to ensure conformity with the rules for legislative technique and finalize the Methodology based on comments and objections collected by the Government of Moldova as part of the public consultation and review process.

Context of the assignment

In 2020-2021, CM Program provided technical assistance to the Government of Moldova in drafting a new Methodology on Calculating Tariffs for Public Waste Management Services. The methodology provides that tariffs will be calculated by waste management operators and will be verified and approved by the local public administration authorities (local councils). According to the proposed Methodology, tariffs for public waste management services will be calculated based on internationally recognized principles and standards, such as the polluter pays principle, charging consumers only for duly justified and necessary costs, provision of waste management services in compliance with the environmental protection legislation, and ensuring transparency in the process of setting and adopting tariffs. In the process of development, the methodology has been consulted widely with national and local public authorities, experts, and waste management operators. Preparation of the Information Note and the Regulatory Impact Assessment is the next step in advancing the discussion and review of the draft Methodology by all stakeholders, including the private sector representatives.   

Duties and responsibilities

  1. Participate in meetings with the Working Group of the State Commission for Entrepreneurial Activity Regulations (Grupului de lucru al Comisiei de stat pentru reglementarea activităţii de întreprinzător), Ministry of Environment, State Chancellery and other relevant working groups on the discussion and review of the draft Methodology.
  2. Edit the current draft Methodology to ensure conformity with the rules of legislative technique in the Republic of Moldova.
  3. Develop the Information Note and the Regulatory Impact Assessment. The documents will be developed according to the legal requirements and official methodology for this category of policy documents.
  4. Finalize the Methodology based on comments and objections submitted by stakeholders as part of the public consultation procedures managed by the Government of Moldova on https://particip.gov.md.

Organizational Setting:

  • The Consultant will work under the overall guidance of the CM Chief of Party and direct supervision of the Policy and Research Manager.

Confidentiality:

  • Materials provided to the consultant and all proceeding the consultancy contract shall be regarded as confidential, both during and after the consultancy. Violation of confidentiality requirements may result in immediate termination of the contract.

 

Skills and experience

 

Education

  • Degree in law or another relevant field such as public administration.

Experience and Skills

  • Extensive experience (at least 3 years) in drafting policy documents, draft laws, policy impact assessments and other similar documents.
  • Professional experience in the areas of waste management and other communal services, public administration will be an advantage.
  • Fluency in Romanian language.

Personal qualities:

  • Responsibility, multitasking, flexibility and punctuality.
