Established in 1951, IOM is a Related Organization of the United Nations, and as the leading UN agency in the field of migration, works closely with governmental, intergovernmental and non-governmental partners. The IOM mission in the Republic of Moldova is in the process of identifying experts from the diaspora of the Republic of Moldova with the aim of supporting the Ministry of Labor and Social Protection of the Republic of Moldova (MLSP) in the process of institutional reform and European integration.

Nature of the consultancy: Consultant on project management   

The overall task of the incumbent will be supporting the State Labour Inspectorate (ISM) of the MLSP of the Republic of Moldova reform by providing projects’ management, stakeholders engagement, strategic and operational planning expertise support in the field of economy formalisation with the view to promote formal employment and decent work conditions for all, including for Moldovan labour migrants.

Project Context and Scope:

In the Republic of Moldova, a significant portion of the occupied population engages in informal employment, which poses numerous challenges to the economy and society. It is estimated that approximately 20.4% of the working population in Moldova is engaged in informal work, as reported by the National Bureau of Statistics (NBS) in 2021. This translates to around 192,000 individuals, accounting for approximately 22.8% of the total employed population. Furthermore, the phenomenon of undeclared work in Moldova results in an annual loss of over 15 billion lei, according to findings by the Expert Group.

Recognizing the need for comprehensive measures to address these challenges, the Ministry of Labor and Social Protection (MLSP) has initiated a structural reform of the State Labor Inspectorate (ISM) to tackle informal employment and foster a fair and functional labor market in Moldova, which focuse on 3 basic directions :

  • Recruiting and training of a new generation of labour inspectors;
  • Improving the legal framework by introducing un-unannounced cheks to identify undeclared/under-declared work and to apply sanctions;
  • Streamlining risk analysis when planning evidence based cheks so that the resources used will be proportional to the level of risk.

In June 2023, the Republic of Moldova demonstrated its commitment to fostering fair and functional labor markets by aligning itself with the European Pillar of Social Rights. This crucial step signifies Moldova's dedication to adopting 20 essential principles and rights that contribute to the well-being of workers and the overall stability of the labor market. Operationalizing this commitment requires the development of an action plan and the implementation of concrete activities. The proposed structural reform of the State Labor Inspectorate (ISM) directly aligns with the objectives of the European Pillar of Social Rights, and it will serve as a catalyst to achieve its principles in Moldova.

Other challenges facing the field include:

  • Society's perception of the State Labor Inspectorate as an ineffective institution that suffocates economic agents and imposes bureaucratic rules on them.
  • Significant losses to the fiscal budget resulting from employment in the informal sector.
  • Lack of information for citizens regarding the risks involved in informal employment and the absence of social protection, particularly in cases of serious and fatal workplace accidents.
  • Isolation of the State Labor Inspectorate and the inability to access funds, projects, and platforms for exchanging experiences at the European and international levels.

Against this background withing the PRM financed project titled “Contribution to the IOM regional appeal for Ukraine and neighbouring countries – 2023”, IOM Moldova is looking for a qualified Moldovan diaspora expert, aiming at supporting the State Labour Inspectorate of the Republic of Moldova reform by providing projects’ management, stakeholders engagement, strategic and operational planning expertise support in the field of economy formalisation with the view to promote formal employment and decent work conditions for all, including for Moldovan labour migrants.

Organizational Department / Unit to which the Consultant is contributing:

Under the overall supervision of the Chief of Mission, and the direct supervision of the Migration and Development Programme Coordinator, the consultant will be responsible for providing effective and efficient support to the ISM of MLSP, within the framework of the PRM financed project “Contribution to the IOM regional appeal for Ukraine and neighbouring countries – 2023”.

Category B Consultants: Tangible and measurable outputs of the work assignment

The main tasks of the expert would include three key areas:

  1. Providing programmatic support to ISM in project implementation and initiatives:
  • Setting a vision for the institutional development of the inspectorate in areas such as human resources, internal training system, annual training plan, strategic planning, communication and promotion, dialogue and relations with the business sector, etc.
  • Implementing and managing projects related to the vision of institutional development.
  1. Enhancing international cooperation of ISM:
  • Strengthening cooperation with European institutions and platforms in the social and labor fields (European Labour Authority, EU-OSHA, EU platform tackling undeclared work, EU Labour Migration platform, etc.) and exploring the possibilities of Moldova's involvement in their activities.
  • Establishing contacts and cooperative relationships with labor inspectorates in other countries, exploring opportunities for joint activities, joint inspections, training, inspection campaigns, etc.
  • Identifying projects and opportunities from which ISM can benefit.
  1. European Pillar of Social Rights:
  • Operationalizing the European Pillar of Social Rights by developing an action plan to achieve the targets set by the EU and implementing them. To do this, the expert will need to analyze the experiences of other countries that have recently aligned themselves to this international instrument, interact with responsible institutions, and exchange experiences.

Within one year, the following tangible and measureable outputs are expected to be achieved by the expert:

  • Institutional development vision for ISM developed.
  • An internal training system planned and developed.
  • Strategic planning support for strengthening the ISM human resources department, support control direction, consultancy and information assistance direction, risk analysis section.
  • Development and implementation of an action plan to achieve the objectives set by the European Pillar of Social Rights by 2030.
  • Development of at least 5 partnerships/Memoranda of Understanding with 5 labor inspections at the European level.
  • Obtaining the role of observer or member in 2 EU institutions/bodies covering labor relations (as listed in point D).
  • Increased visibility of ISM at the national and international levels.

Performance indicators for the evaluation of results

  • Brief monthly progress reports counter-signed by MLSP focal point and endorsed by IOM Moldovan Migration and Development Programme Coordinator;
  • Monthly timetable of performance counter-signed by the MLSP focal point

Education, Experience and/or skills required

  1. Complete higher education. Experience in international law, human rights, project management, communication, etc. Experience in EU institutions could be an advantage;
  2. Organizational and planning skills;
  3. Experience in change management, institutional consolidation, performance evaluation;
  4. Experience in project cycle management;
  5. At least five years of prior work experience in the mentioned domains.
  6. Fluency in Romanian and English. Knowledge of another EU language is an advantage;
  7. Interaction and communication skills with European institutions, governments, ministries from other countries, labor inspectorates;
  8. Advanced computer knowledge.
