TITLE: Consulting services to deliver an independent, integrated and decision-oriented assessment of MITP’s performance since its launch

Indicative duration: 12 weeks

Terms of reference (ToR): Core technical document, in English, contains the detailed project requirements and will be made available to bidders upon request during the procurement process.

1. BACKGROUND

The Terms of Reference define an independent strategic evaluation of Moldova Innovation Technology Park (MITP), its special regulatory and single-tax framework, and its future role in Moldova’s economic and European integration agenda. The assignment is intended to support proposals by MITP and the Ministry of Economic Development and Digitalization (MDED), and decision by the Government of the Republic of Moldova, as well as evidence-based technical consultations and, where formally authorised, accession-related discussions with the European Union.

The procurement is designed for an internationally recognised consulting firm or consortium able to combine economic and fiscal analysis, EU State aid and competition law, digital economy and innovation policy, and institutional strategy. Requirements are expressed in terms of capability and relevant experience and do not reserve participation to any named group of firms.

2. Purpose of the Assignment 

The purpose is to deliver an independent, integrated and decision-oriented assessment of MITP’s performance since its launch and to recommend a legally robust and economically sustainable development model for the next decade.

The outputs will be used to:

1. inform strategic decisions by the MITP Administration, the MITP Council, MDED and the Government;
2. support the review of Law No. 77/2016, Government Decision No. 1144/2017 and related fiscal and institutional arrangements;
3. define measures to increase innovation, product development and technology adoption in Moldova;
4. prepare an implementation roadmap up to 2035 and for the period beyond;
5. support technical consultations and accession-related discussions with the European Union;
6. provide a defensible Position Paper on EU alignment and a possible transition period;
7. improve the monitoring and evaluation framework for MITP.

The principal evaluation period will run from 2018 to the latest year for which sufficiently complete and validated data are available. The analysis will include an appropriate pre-2018 baseline and forward-looking scenarios up to 2035 and beyond.

3. Objective of the Assignment 

3.1 Overall objective

To determine the net economic and fiscal impact, continuing relevance, EU-law implications and future strategic role of MITP, and to provide implementable recommendations for a modernised and EU-aligned framework.

3.2 Specific objectives

The Consultant shall:

• reconstruct the original problems, intervention logic, assumptions, targets and alternatives underlying the establishment of MITP;
• compare actual results with the original expectations and with a credible counterfactual;
• estimate the net fiscal and economic effects of the MITP framework, as well as any significant social effects;
• assess formalisation, additionality, incentive effects and possible deadweight, displacement or spillover effects;
• assess the framework under Moldovan competition and State aid law 182/2026, the Association Agreement and the relevant EU acquis;
• identify concrete legal and policy options for continued operation, adjustment, phased transition or replacement;
• benchmark a limited number of relevant competing jurisdictions and extract transferable lessons;
• identify and prioritise the new economic and technological problems MITP should address;
• propose verifiable ways to give greater priority to product development, R&D, innovation and technology adoption without unjustified discrimination or unmanageable compliance burdens;
• assess MITP’s mandate, governance and delivery capacity in light of a possible expanded role;
• compare strategic scenarios and recommend a preferred model; and
• prepare a sequenced roadmap and a Position Paper for EU-related discussions.
