Key areas of responsibility

  1. prioritized pipeline of legal and institutional reforms affecting asylum-seekers, refugees, beneficiaries of humanitarian protection and beneficiaries of temporary protection, with responsible institutions, decision points, deadlines and expected results;
  2. review primary and secondary legislation, administrative procedures and institutional mandates affecting refugees, beneficiaries of humanitarian protection, asylum-seekers, beneficiaries of temporary protection and, where relevant, other foreigners, and identify precisely what must change to enable access to employment, self-employment, social protection and related services;
  3. develop amendment concepts, draft legal and regulatory provisions, explanatory notes and implementation pathways together with the institution legally responsible for each measure, so that an identified barrier becomes a proposal that can enter the formal legislative process;
  4. map rights and responsibilities across the different legal statuses (asylum-seekers, beneficiaries of temporary protection, recognized refugees and beneficiaries of humanitarian protection, and other foreigners as relevant), to identify gaps, inconsistencies and the legal implications of transitions between statuses;
  5. support inter-ministerial coordination and stakeholder dialogue on the Economic Council Platform for legal and institutional reforms, convening the institutions whose agreement is required, surfacing legal disagreements early, and helping to broker a common position before a proposal enters formal clearance;
  6. identify and resolve administrative and interoperability barriers that do not require a legal amendment but still prevent people from exercising an existing right, including data-exchange, registry interoperability, documentation and procedural bottlenecks between MIA/IGM, MLSP, ASP, SFS, ANOFM and other relevant institutions;
  7. design and support the implementation of workable referral arrangements between MIA/IGM, MLSP and other institutions, so that vulnerable beneficiaries of temporary protection, asylum-seekers and recognized refugees/beneficiaries of humanitarian protection move from status determination to effective access to rights, social protection and other services without unresolved referrals between institutions;
  8. provide legal and drafting support to priority workstreams identified with the Secretariat, including the legal and administrative framework for the employment of foreigners, the validity period of documentation issued to asylum-seekers, the freelancer regime, active labor-market measures, the social protection roadmap and the legal and institutional aspects of transitioning from temporary protection to longer-term solutions;
  9. for each legal or regulatory measure under review, assess what implementation would require in institutional and procedural practice, including staffing, digital changes and local-level responsibilities, so that a proposal is realistic before it enters the legislative process;
  10. maintain a legal and institutional reform tracker recording the status of each priority measure, the responsible institution, the action required and the next decision point, and follow up agreed actions with responsible institutions;
  11. work jointly with the Socio-Economic Inclusion and Policy Coordination Expert to ensure that legal and institutional reform proposals are grounded in the economic, fiscal and operational evidence developed under that role, and that both profiles present a coordinated position to government counterparts;
  12. mobilize additional legal or specialist expertise when required, drawing on existing Economic Council experts, ministries, UNHCR and UN partners, and short-term specialist inputs for complex legal, digital or sectoral drafting work, rather than personally performing every specialist analysis;
  13. prepare legal and policy dossiers, briefing notes, explanatory memoranda and presentations for the Secretariat, government counterparts and UNHCR, as required;
  14. build and maintain constructive working relationships with the relevant ministries and state agencies, municipalities, the European Union Delegation, international financial institutions, and civil-society and private-sector partners, as relevant to specific legal reforms;
  15. maintain regular technical coordination with UNHCR, including timely sharing of draft legal analyses, amendment concepts and other relevant outputs;
  16. contribute to the joint development and periodic review of workplans and priorities with the Economic Council Secretariat and UNHCR;
  17. participate in regular coordination and review meetings organized with UNHCR and other relevant stakeholders; and
  18. perform other legal- and institutional-reform-related technical tasks within the scope of these Terms of Reference, as agreed jointly by the Secretariat of the Economic Council and UNHCR.
