TENDERE, ACHIZIȚII ȘI CONTRACTĂRI ÎN MOLDOVA

The German Development Cooperation through GIZ is looking for a company or a consortium of companies able to support National Penitentiary Administration in the implementation of the Law no. 171/2026, which enters into force on January 1st, 2027, by bringing subsidiary normative framework in accordance and ensuring further institutional consolidation, within its “Strong Businesses and Communities for Moldova” project.

The objective of this assignment is to offer a complex support, legal and expert advice to National Penitentiary Administration (NPA) at all stages of normative framework development, respecting a tight deadline for processes that involve multiple stakeholders. It is expected that the new regulations will facilitate the involvement of companies and enable the development of sustainable partnerships. Also, implementation of these measures will contribute to increasing interest in work, support vocational training, especially dual VET programs, encourage financial autonomy, and facilitate the return of convicted persons to society after serving their sentence.

To achieve the objective, the expert shall perform the following tasks:

• Based on the newly approved law on detainees’ work, conduct an inventory of the existing and need to be developed normative framework and set up together with the NPA team a calendar of working activities.
• Provide legal assistance and coordination of processes in the development of normative acts and in the final draft submission. This will also include preparation of synthesis of objections and proposals from public authorities and civil society, elaboration of informative notes when needed, and the elaboration of legal opinions on issues that will appear during the process.
• Follow the legal path for approval of each subsidiary document and manage procedures while also being involved in revising and adjusting the drafts.
• Organise and conduct meetings with relevant authorities and ensure a constructive dialogue for the advancement of the working calendar and achievement of objectives. Assist NPA in conducting debates and ensure necessary legal support.
• Organisation of up to five one-day workshops that will involve key personnel from NPA and representatives from other relevant institutions.
• Offer support and expertise to the NPA staff and management, MoJ, covering necessary methodological consultancy to other stakeholders involved in the implementation of the Law.
• Support with legal and complex expert advice in problem solving for organisation and regulation of new processes for main beneficiaries as well as for the other authorities involved in the implementation. Build dialog, find reliable solutions and mediate between parties in disagreement.
• Provide final recommendations, based on the results and lessons learned under the assignment.

The tender is open to private companies, public institutions, non-government organizations, professional associations, or consortia, resident in the Republic of Moldova, established and operating in accordance with the legislation of the Republic of Moldova. For a consortium, a Consortia Declaration (as per the template provided) should be included in the technical offer.

Eligible applicants must be public or private legal entities established and registered in the Republic of Moldova in accordance with the national legal framework.

Within the proposal, the bidder will present:

• Financial bid(submitted strictly in accordance with the provided Price schedule template), including detailed budget expressed in Moldovan Lei, VAT 0.
• Technical offer that must compulsorily contain (in a separate sealed envelope, length of the offer will not exceed 5 pages, excluding CVs, certificates, and authorizations):
• Company/organization profile.
• Concept for delivering the service according to the ToR.
• Personnel concept according to the ToR, including CVs of the proposed experts.
• Copy of the company registration certificate in the Republic of Moldova, any available license, permits, professional qualification certificate available.
• Completed self-declaration(signed).

Offers must be prepared in English or Romanian.

Bids evaluation will be performed based on the ratio 70% for the technical offer and 30% for the financial offer.

Applications must be submitted electronically to MD_Quotation@giz.de not later than 17.11.2026, time 17:00. The subject of the email must always state the transaction number (10056705). The application must be submitted in one (1) email including two (2) zip folders: (a) TECHNICAL BID – 10056705, (b) FINANCIAL BID – 10056705.

Please note that applications received after the deadline, as well as incomplete applications will not be considered. Financial offers containing other currency than Moldovan Lei, will not be considered. GIZ retains the discretion to re-advertise or cancel this tender.
