The German Development Cooperation through GIZ is looking for one Senior legal expert to provide technical assistance and support to 4 LPAs from Leova rayon in establishing the Intermunicipal cooperation system in Solid Waste Management sector and replicate best experiences to 7 selected LPAs from Straseni rayon, within its “Strong Businesses and Communities for Moldova” project.

The selected expert will conduct all the activities in accordance with the provisions of the Terms of Reference (ToR).

The objective of this assignment is to carry out capacity development activities and provide technical assistance to 4 LPAs from Leova rayon: Iargara, Baius, Tigheci and Sarata Noua communes in becoming associates within the reorganised LLC "Servicii Salubrizare” operator, elaborate the regulation on city maintenance SWM public service, identifying a related payment mechanism (tariff/taxes), drafting the service delegation contract and replicating best experiences in establishing a SWM intermunicipal operator among 7 LPAs from Straseni rayon (Radeni, Greblesti, Negresti, Romanesti, Onesti, Tiganesti, Codreanca).

To achieve the assignment objective, the expert shall perform the following tasks:

• Provide the methodological support to 4 LPAs and SWM operator LLC "Servicii Salubrizare” from Leova rayon, as well as to 7 LPAs from Straseni rayon.
• Develop an action plan, discuss and validate it with representatives from selected LPAs form Leova and Straseni rayon.
• Support the local councils from Leova rayon in taking required legal decisions to become associates at the LLC "Servicii Salubrizare” SWM operator.
• Facilitate the process of increasing the share capital and accepting the new associates LPAs Sarata Noua, Tigheci and Baius within the reorganised LLC "Servicii Salubrizare” SWM operator.
• Introduce the requested amendments into the LLC "Servicii Salubrizare” SWM operator statute.
• Provide support to reorganised LLC "Servicii Salubrizare” SWM operator from Loeva in drafting 5 internal regulations/procedures.
• Elaborate the regulation on Solid Waste Management public services, including payment mechanism (tariff/taxes) and service delegation contract with annexes.
• Organize workshops for Straseni rayon representatives of LPAs and operator to present the required steps, templates and needed decisions, lessons learned and best practices in establishing a SWM intermunicipal operator.
• Develop a Roadmap/Strategic Plan – how to establish a public intermunicipal operator in the SWM sector for interested 7 LPAs from Straseni rayon.

The expert will fulfil the tasks in close coordination with the representatives of LPAs and GIZ/SBC project. The tender is open to individual experts, resident in the Republic of Moldova.

Offers must be prepared in English. The applications shall include:

• Technical offer consisting of:
• detailed CV,
• concept note* (maximum 3 pages, a brief outline of the assignment implementation) including:
  • expert vision on the current situation,
  • relevance of the assignment for key involved stakeholders,
  • main activities, proposed methodology, sustainability results and optimal timelines for the proposed assignment,
  • allocation of expert days per each deliverable/rayon.
  • cooperation with the GIZ team, LPAs from Leova and Straseni rayon.
• Financial offer including:
  • gross daily rate in MDL and a total amount per up to 40 workdays of assignment.
  • total budget in MDL.

The transportation costs for the Senior legal expert to Leova and Straseni rayons will be ensured by the project.

Only costs as per the financial offer are subject to reimbursement.

Bids evaluation will be performed based on the ratio 70% for the technical offer and 30% for the financial offer.

Please note that applications received after the deadline, as well as incomplete applications will not be considered. Financial offers containing other currency than Moldovan Lei, will not be considered. GIZ retains the discretion to re-advertise or cancel this tender.
