The German Development Cooperation through GIZ is looking for a consultant to develop the draft law on amendments to national legal framework in line with the new law on Industrial Emissions no. 227 from 30.09.2022  within its regional project “Capacity Development for climate policy in the countries of South East, Eastern Europe, the South Caucasus and Central Asia, Phase III’ (CDCPIII)”

The selected consultant will conduct all the activities in accordance with the provisions of the Terms of Reference (ToR).

The objective of this assignment is to support the Ministry of Environment to develop the mentioned draft legal package according to the IE Law and national legislation and develop the Regulatory Impact Analysis (RIA) for the draft Law.

Following the background information of the objective to develop the final draft Law on amendments, the draft decision on amendments to the Governmental Decisions and RIA for amendments of legal framework to the Industrial Emissions Law, the National Expert (NE) is expected to:

• Develop the RIA in accordance with the national methodology approved by Government Decision no. 23 from 18.01.2019. Advice will be given by an International Expert;
• Conduct a detailed analysis of the relevant/sectoral legal/normative framework and identify the acts to be amended;
• Develop the draft law and draft decision on amendments of GD in accordance to the Law no. 100/2017 on normative acts;
• Develop the Informative notes and the summary table of proposals and objections to the draft Law and draft a decision on amendments to GD in accordance with the requirements;
• Participate in relevant meetings, workshops and field visits, if necessary.

The tender is open to nationals of the Republic of Moldova and persons with legal residence in the Republic of Moldova.

Offers must be prepared in English. The application shall include:

• cover letter;
• detailed CV;
• financial offer including gross (brutto) daily rate in Moldovan Lei (MDL) and a total amount per up to 60 workdays of assignment (in a separate document).

All personal data are for the internal use of GIZ; confidentiality is guaranteed.

Successful offerors will be further asked for additional documentation such as copy of ID, bank data and other, as it might be required for the contracting. The successful finalist will be issued a short-term consulting contract.

Applicants shall hold the Moldovan citizenship for a period of at least 6 months at the date of application.

Bid’s evaluation will be performed based on the ratio 70% for the technical aspect (CV) and 30% for the financial offer. Shortlisted candidates might be asked for an interview and additional information.

Applications shall be submitted in a sealed envelope to the GIZ country office – Chisinau, 73/1 Stefan cel Mare si Sfant Bvd., National Business Center, 9^th floor – indicating the tender number (83437784), not later than May 26, 2023, 15:00 Chisinau local time.

Please note that applications received after the deadline, as well as incomplete applications will not be considered. Financial offers containing other currency than Moldovan Lei, will not be considered. GIZ retains the discretion to re-advertise or cancel this tender.
