The German Development Cooperation through GIZ is looking for a company or a consortium of companies that will provide assistance to the Ministry of Education and Research in the process of bringing the normative acts in accordance with the provisions of the Law on Dual VET (110/2022), within its “Strong Businesses and Communities for Moldova” project.

The objective of the assignment is to provide assistance and advice in the process of bringing the normative acts in accordance with the provisions of the Law on Dual VET (110/2022). This includes the consolidation of the normative framework triggered by the adoption of the Law on Dual VET (Law 110/2022) and related secondary legislation but also further institutional strengthening through the consolidation of capacities of the main actors involved, including dual partners, the Ministry of Education and Research, as well as the Chamber of Commerce and Industry as competent body for quality assurance of in-company training.

To achieve the assignment objective, the selected service provider shall perform following activities:

• Participating within the meetings of the Working Groups that will deal with the elaboration of the drafts of the normative acts inferior to the Law on dual VET, by ensuring the necessary legal support;
• Providing consultancy to the public authorities (Ministry of Education and Research, Ministry of Economy, Chamber of Commerce and Industry etc.) in determining the category, concept and establishing the structure of normative acts inferior to the Law on dual VET, by submitting initial proposals, carrying out any research studies and elaboration or analysis of other materials;
• Providing legal assistance to the public authorities in the elaboration of the initial version of the draft normative acts and in the elaboration of the informative notes;
• Providing legal advice to the public authorities in the process of public consultation, approval of the draft normative act, as well as the preparation of the synthesis of objections and proposals of public authorities and, as appropriate, the synthesis of recommendations of civil society representatives;
• Providing legal assistance to public authorities in drafting the final version of draft normative acts inferior to the law;
• Assisting the author of the draft normative acts in organizing and conducting the debates with the participation of the representatives of the public authorities and of the interested institutions, of the civil society;
• Elaborating legal opinions on the legal issues that will appear in the process of elaboration and adoption of the normative acts inferior to the Law on dual VET.

The tender is open to private companies, public institutions, non-government organizations, professional associations, or consortia, resident in the Republic of Moldova, established and operating in accordance with the legislation of the Republic of Moldova. For a consortium, a cooperation agreement should be included in the technical offer.

Offers must be prepared in English or Romanian.

Proposals must be submitted in two parts, consisting of:

• Part 1, in a separate envelope: Technical offer, according to the TOR (the technical offer segment),
• Part 2, in a separate envelope: Financial offer, according to the TOR (the financial offer segment) - detailed budget expressed in Moldovan Lei, VAT 0.

Bids evaluation will be performed based on the ratio 70% for the technical offer and 30% for the financial offer.

Applications shall be delivered in sealed envelopes (physical form), showing the tender number (83414061) and subject on it, to the address of GIZ Office Chisinau (73/1 Stefan cel Mare si Sfant Boulevard, NBC building; 9^th floor, Chisinau) not later than August 2, 2022 time 15:00.

Please note that applications received after the deadline, as well as incomplete applications will not be considered. Financial offers containing other currency than Moldovan Lei, will not be considered. GIZ retains the discretion to re-advertise or cancel this tender.
