Tender no 83318792 for the contracting of a national legal expert to draft the legislation for the European Union Industrial Emissions Directive transposition

The German Development Cooperation through GIZ is looking for an individual expert to draft the legislation for the European Union (EU) Industrial Emissions Directive transposition (IED), within “Capacity Development for Climate Policy in the countries of South East, Eastern Europe, the South Caucasus and Central Asia, Phase III’ (CDCP III)” project.

The legal document will cover the rules necessary to transpose the EU IED into Moldovan legislation, according to the Moldovan rules of drafting new legislation. The legislation will be the framework for the implementation of the EU IED; it will need to be implemented later-on by more specific secondary legislation. Any reference in this document to “legislation to transpose the EU IED” is to be understood as the framework legislation.

The following responsibilities are included in the assignment:

  • Participate in the meetings, workshops and field visits with the international expert;
  • Participate in discussions with the Ministry of Agriculture, Regional Development and Environment

 and other stakeholders on the draft legislation to transpose the EU IED;

  • Provide information on the existing national legislation relevant for the transposition of the EU IED;
  • Provide information on related relevant projects and their results;
  • Upon advice and support by the international expert, prepare draft legislation for the transposition of the IED into national legislation considering the existing rules of drafting new legislation in the Republic of Moldova;
  • Support the project in elaboration processes for the preparation of the new legislation on IED transposition;
  • Assist the project in revising the draft legislation in the consultation process.

Required qualifications:

  • University degree in Law (Master’s degree);
  • At least 3 years of proven experience in delivering legal consultancy services to public sector;
  • Proven experience in developing normative acts in accordance to national methodology and consultation/reviewing process with the respective State Commission;
  • At least 2 years of experience in drafting legal acts, various regulations and similar documents, oriented to environment and/or the regulation of the economic sector;
  • Previous experience in providing services and cooperating with international experts in the field of development assistance or related work for a donor organization, governmental institutions, or NGO will be an asset;
  • Knowledge of national environmental law, EU environmental policy, EU legal and regulatory framework, and international best practices related to environment protection will be an asset.

  • detailed CV and cover letter, explaining the motivation for the position;
  • financial offer, including gross daily rate in MDL (Moldovan Lei) and a total amount per up to 60 work days of assignment, for the period April 2019 – December 2019;
  • copy of ID, health insurance and social insurance card (CPAS);
  • bank data, showing bank name, bank code and IBAN (MDL).

The successful finalist will be issued a short-term consulting contract with the possibility of further extension.
