Project objective

The Project “Support to Enforcement of the Intellectual Property Rights” has started on 10 November 2016 and will last for two years until November 2018.

The overall objective of the Project is to improve the application of the law and regulations on Intellectual Property Rights in the Republic of Moldova.

The expected results of the Project are the following:

  • Improved communication and effectiveness of IP enforcement in the Republic of Moldova;
  • Communication system set-up between the main contributors to IP protection;
  • Enhanced competence and effectiveness of all staff and officials involved in IP protection and enforcement;
  • Improved awareness of the rights and obligations of the IP community in the Republic of Moldova;
  • Improved protection and capitalization of Geographical Indications in the Republic of Moldova.

Specific work requirements

The overall objective of this mission is to develop the regulatory framework necessary for the successful lunch and implementation of e-IPR system as also for ensuring its long-term sustainability.

The specific objectives of this Mission are:

  • Analysis of the current legislative and identifying the correct legal framework/umbrella for defining the eIPR system. (5 days)
  • Liaising with all stakeholders of the eIPR system and identifying the legal basis for the cooperation on the eIPR platform and data exchange through the governmental e-services. (10 days)
  • Liaising with the Personal Data Protection Agency and assuring the use of the personal data within the eIPR is within the law. (2 days)
  • Liaising with the governmental e-services (e.g. Population register, Companies register, Address register etc.) and providing the legal basis for the information usage and exchange between AGEPI, the stakeholders and these institutions. (5 days)
  • Drafting the Governmental Decision regarding the setting up of e-IPR system; (3 days)
  • Drafting the Concept of the e-IPR system for the integration in the e-Governmental systems; (2 days)
  • Drafting the Regulation related to the functioning of e-IPR system. (3 days)

Results and deliverables

The expected outputs and results of this Mission are:

  • Draft Governmental Decision for the setting up of e-IPR System, the approval of the Concept and of the Regulation for the functioning of the e-IPR system.

Education and skills

  • Master’s degree or higher in Law;
  • Strong knowledge of the Moldovan legal and regulatory framework in the field of information and technology;
  • Excellent analytical and legal writing skills;
  • Knowledge of IPR activities and of e-governance agenda will be an asset;
  • Demonstrated interpersonal skills, as well as the ability to communicate effectively with all stakeholders and to present ideas clearly and effectively;
  • Fair knowledge of English language, both spoken and written;
  • Ability to prepare clear and concise reports in English;

Professional experience

  • At least 4 years of relevant professional experience in writing legal instruments (including bills, decisions, regulations, etc.);
  • Previous professional experience in working with e-government resources will be an asset;
  • Experience in developing technical concepts and regulations on information and communication systems;
  • Experience in providing assistance to central public authorities on the development of IT documentations.

Subordination and Cooperation

Reports and draft recommendations produced by the JNKE shall be submitted to the Project Team Leader and Key Expert 2. The expert will cooperate with the project team, STE and all beneficiary organizations. The expert will submit a written report at the end of the assignment.
